Italy's antitrust authority has opened an investigation into U.S. music-generating artificial intelligence company Suno Inc. over terms of service that it says may unfairly limit consumer rights. The Italian competition authority said the terms may create a significant imbalance in the rights and obligations under the contract to the detriment of consumers, appearing to give Suno broad powers to change its contract, services, and subscription prices without providing a reason, and to suspend or terminate accounts and delete associated content at any time and without prior notice. The authority is also examining provisions requiring users to accept additional terms that may not be directly available before they enter into the contract, as well as broad limits on Suno's liability. The investigation further covers copyright provisions, with the authority saying the license users grant to Suno may be too broad and unclear and that the terms appear to require users to waive certain moral rights protected under Italian copyright law. Suno's terms also require users to pursue claims through individual binding arbitration in the United States and waive class-action lawsuits while giving courts in Massachusetts exclusive jurisdiction, the authority said, adding that it plans to hold a public consultation on the terms in the coming weeks open to eligible business and consumer associations and chambers of commerce.
