Gogo IncDelaware court overturned the $22.7M patent-infringement damages award against Gogo, removing a legal liability.

A U.S. district court in Delaware overturned a jury decision to award $22.7M to the plaintiffs in a patent case against Gogo Inc., ruling that SmartSky Networks failed to present sufficient evidence that it suffered legally recoverable damages and that the amount of the award was unsupported by the actual facts. SmartSky sued Gogo for patent infringement in February 2022, claiming Gogo's 5G air-to-ground inflight connectivity service illegally used SmartSky's proprietary technology. In November 2025, a jury agreed with SmartSky that Gogo infringed on its four patented technologies, but the $22.7M monetary award was set aside because SmartSky failed to legally prove its calculated damages. Although the decision is subject to appeal, Gogo applauded the court's decision regarding the award, calling it a significant step in resolving the matter and saying the court found SmartSky's damages award was untethered to the evidentiary record. SmartSky said the court upheld the jury's findings that Gogo willfully infringed its valid patents, adding that it is disappointed with the damages ruling and is evaluating its options for further relief.
